These Terms of Use (“Terms”) govern your access to and use of the 2BFound mobile application, the website at 2bfound.co.uk and related services (together, the “Service”).

The Service is operated by:

In these Terms, “2BFound”, “we”, “us” and “our” mean 2BFOUND LTD.

By creating a 2BFound account or otherwise using the Service, you agree to these Terms.

Our Privacy Policy explains how we collect and process personal information and forms an important part of your use of the Service.

If you do not agree to these Terms, you must not create an account or use the Service.

1. About 2BFound

2BFound is a people-first shared-living platform designed to help adults discover and communicate with people with whom they may wish to live, organise potential shared households through Cases, explore accommodation Listings and communicate with Hosts and Business Hosts.

2BFound provides technology for discovery, communication and organisation.

Unless expressly stated otherwise, 2BFound is not:

  • a landlord;
  • a tenant;
  • a letting agent acting for a user;
  • a property manager;
  • a guarantor;
  • a party to tenancy agreements between users;
  • a provider of legal, financial, property or housing advice.

2BFound does not itself decide who should live together or whether a particular property, person, Case or living arrangement is suitable for you.

2. Eligibility

You must be at least 18 years old to create an account or use 2BFound.

By creating an account, you confirm that:

  • you are at least 18 years old;
  • you have legal capacity to agree to these Terms;
  • the information you provide is materially accurate;
  • you are not prohibited by law from using the Service.

We may suspend or remove an account if we reasonably believe that the user does not meet these requirements.

3. Your account

You are responsible for activity carried out through your account.

You must:

  • provide accurate information;
  • keep relevant account information reasonably up to date;
  • maintain control of the email account used to access 2BFound;
  • not allow another person to impersonate you through your account;
  • notify us if you reasonably believe your account has been compromised.

You must not create an account using another person’s identity or deliberately provide materially false or misleading identity information.

4. Profiles

2BFound allows users to create profiles containing information that may help other users understand whether they could be suitable people to live with.

Depending on available features, profiles may contain information such as photographs, biography, occupation, education, languages, lifestyle information, housing preferences and other information voluntarily provided by the user.

Some profile information is visible to other users.

You are responsible for deciding what optional information you publish.

You must not knowingly publish information that:

  • impersonates another person;
  • materially misrepresents who you are;
  • violates another person’s privacy;
  • infringes intellectual property rights;
  • is unlawful;
  • is fraudulent or deliberately misleading;
  • violates these Terms or our Community Guidelines.

5. Optional sensitive profile information

Certain optional profile features may allow you to provide information such as sexual orientation.

Such information is voluntary unless clearly stated otherwise.

You are not required to provide optional sexual orientation information in order to maintain a basic 2BFound account.

Where applicable, 2BFound will request separate explicit consent before processing optional special category personal information where such consent is required under data protection law.

That consent is separate from your acceptance of these Terms.

You may withdraw such consent as explained in our Privacy Policy and through any controls made available within the Service.

6. Cases

A “Case” is a user-created plan for a potential future shared household.

Users may, depending on available functionality:

  • create Cases;
  • join Cases;
  • request to join Cases;
  • invite other users;
  • leave Cases;
  • discuss shared-living expectations;
  • associate Listings or other relevant information with a Case.

Creating or joining a Case does not create a tenancy, partnership, joint venture or other legal relationship between 2BFound and the Case members.

It also does not guarantee that members of a Case will ultimately live together.

Users remain responsible for deciding whether to enter into any living, tenancy or financial arrangement with another person.

7. Listings

Hosts and Business Hosts may be able to create and publish accommodation Listings.

Users publishing Listings are responsible for ensuring that information they provide is accurate and lawful.

A Listing must not knowingly contain materially false or misleading information about a property, including its availability, price or material characteristics.

Unless expressly stated otherwise, 2BFound does not independently verify every Listing, property, Host or representation made by a user.

Publication of a Listing does not constitute endorsement, certification or guarantee by 2BFound.

Users should carry out appropriate checks before entering into a tenancy, paying money, providing sensitive documentation or making other significant commitments.

8. Hosts and Business Hosts

2BFound may provide different functionality for Hosts and Business Hosts.

A Business Host may be required to purchase a subscription or other paid service to access particular commercial functionality.

Hosts and Business Hosts are responsible for complying with laws and regulations applicable to their accommodation, advertising, property activities and relationships with prospective or actual tenants.

2BFound does not assume those legal obligations on their behalf.

9. Messages and communications

2BFound may provide private messaging and group-chat functionality.

Messages sent through 2BFound are communications between participating users and are not SMS messages.

You must not use messaging functionality to:

  • threaten or harass another person;
  • send unlawful material;
  • commit or facilitate fraud;
  • send malicious software;
  • unlawfully obtain personal or financial information;
  • repeatedly send unwanted communications;
  • promote illegal activity;
  • violate another person’s rights.

We may review relevant communications where reasonably necessary to investigate reports, suspected abuse, safety concerns or violations of these Terms or our Community Guidelines, as described in our Privacy Policy.

10. User conduct

You must use 2BFound lawfully and respectfully.

You must not use the Service to:

  • harass, threaten, intimidate or abuse another person;
  • discriminate unlawfully;
  • impersonate another person;
  • commit or facilitate fraud;
  • advertise unlawful accommodation;
  • distribute illegal or harmful content;
  • attempt to obtain unauthorised access to another account;
  • interfere with the operation or security of the Service;
  • introduce malware or malicious code;
  • scrape or systematically extract information without authorisation;
  • circumvent technical restrictions or security controls;
  • misuse reporting or moderation systems;
  • use the Service for activity prohibited by applicable law.

Our Community Guidelines may contain additional rules governing acceptable behaviour and content.

11. User content

“User Content” means photographs, text, messages, Listing information, Case information and other material you submit through 2BFound.

You retain ownership of intellectual property rights you hold in your User Content.

By submitting User Content, you grant 2BFound a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, display and technically adapt that content only to the extent reasonably necessary to operate, provide, secure and improve the Service.

This licence does not transfer ownership of your User Content to 2BFound.

The licence ends when the relevant content is deleted from our systems, except to the extent that continued retention is reasonably necessary for backups, legal obligations, disputes, security, moderation or other legitimate purposes described in our Privacy Policy.

You must have the necessary rights to content you upload.

12. Photographs

You must only upload photographs that you have the right to use.

You must not knowingly upload photographs that unlawfully violate another person’s privacy, copyright or other rights.

We may remove photographs that violate these Terms, our Community Guidelines or applicable law.

13. Reports, blocking and moderation

Users may have access to reporting and blocking functionality.

We may investigate reported accounts, content or activity.

Depending on the circumstances, we may:

  • take no action;
  • issue a warning;
  • remove content;
  • restrict functionality;
  • temporarily suspend an account;
  • permanently terminate an account;
  • take other proportionate action reasonably necessary to protect users, the Service or third parties.

We are not required to disclose confidential information concerning another user or detailed internal moderation processes.

14. Safety and interactions with other users

2BFound helps people discover and communicate with other users, but we cannot guarantee the identity, intentions, behaviour, suitability or truthfulness of every user.

You are responsible for your decisions and interactions with other users.

You should use reasonable care before:

  • meeting another user;
  • visiting a property;
  • inviting someone to a property;
  • entering into a tenancy or other agreement;
  • transferring money;
  • providing identity documents;
  • sharing financial or other sensitive information.

If you believe there is an immediate threat to someone’s safety, contact the appropriate emergency services.

15. Payments, subscriptions and promotions

Some 2BFound functionality may require payment.

Paid functionality may include subscriptions, promotional services or other products made available from time to time.

Prices and applicable terms will be displayed before purchase.

Depending on the platform and product, payments may be processed through a third-party payment provider or an application-store payment system.

2BFound does not store full payment-card information on its own systems.

Subscriptions may renew automatically where clearly stated at the time of purchase.

Where purchases are made through Apple App Store or Google Play, applicable payment, cancellation and refund rules of the relevant platform may also apply.

Nothing in these Terms limits mandatory consumer rights that apply to you under law.

16. Promotions and boosted content

2BFound may allow eligible users to pay for increased visibility or promotion of Profiles, Cases, Listings or other content.

Purchasing promotion does not guarantee:

  • a particular number of views;
  • messages;
  • requests;
  • enquiries;
  • matches;
  • tenants;
  • Cases;
  • transactions;
  • any particular outcome.

Promotion affects visibility only as described when the relevant product is purchased.

17. Third-party services

2BFound may depend on or integrate with third-party services, including services relating to location search, payment processing, application infrastructure and notifications.

Third-party services may be governed by their own terms and privacy policies.

We are not responsible for third-party services outside our reasonable control.

18. Intellectual property

Except for User Content and third-party materials, the 2BFound Service, including its software, design, branding, logos, graphics, databases and other proprietary materials, is owned by or licensed to 2BFOUND LTD and is protected by applicable intellectual property laws.

You may use the Service only for its intended purposes in accordance with these Terms.

You may not copy, distribute, modify, sell, license, reverse engineer or commercially exploit protected parts of the Service except where permitted by law or expressly authorised by us.

19. Privacy

Our processing of personal information is described in the 2BFound Privacy Policy.

The Privacy Policy explains, among other things:

  • what information we collect;
  • why we process it;
  • applicable lawful bases;
  • how information may be shared;
  • international transfers;
  • retention;
  • account deletion;
  • your data protection rights;
  • how to contact us.

Acceptance of these Terms does not constitute explicit consent to processing special category personal data where separate explicit consent is required by law.

20. Availability and changes to the Service

We aim to provide a reliable Service but do not guarantee uninterrupted or error-free availability.

The Service may occasionally be unavailable because of:

  • maintenance;
  • updates;
  • technical failures;
  • security incidents;
  • third-party service failures;
  • circumstances outside our reasonable control.

We may add, modify or remove functionality where reasonably necessary to develop, secure or operate the Service.

21. Suspension and termination

We may restrict, suspend or terminate access to all or part of the Service where reasonably necessary, including where:

  • these Terms are materially or repeatedly violated;
  • our Community Guidelines are violated;
  • fraudulent or abusive activity is suspected;
  • another person’s safety may be at risk;
  • an account presents a security risk;
  • we are legally required to do so.

Where reasonably appropriate, we may provide notice or an opportunity to address the issue.

Serious safety, fraud, security or legal concerns may require immediate action.

22. Account deletion

You may request deletion of your account using the account-deletion functionality provided by 2BFound or the external deletion method made available through our website.

Account deletion and retention of associated personal information are governed by our Privacy Policy and applicable law.

23. No guarantee of compatibility or outcomes

2BFound provides tools intended to help people discover potential shared-living arrangements.

We do not guarantee:

  • compatibility between users;
  • that another user will respond;
  • that a Case will result in a shared household;
  • that accommodation will be available;
  • that a Listing is suitable for you;
  • that a Host will accept a user;
  • that a tenancy will be created;
  • any particular social, housing or financial outcome.

Users remain responsible for their own decisions.

24. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded.

Subject to applicable law, 2BFound is not responsible for losses caused by another user’s conduct, representations or failure to perform an agreement between users where 2BFound is not a party to that agreement.

We are also not responsible for losses that were not reasonably foreseeable when you agreed to these Terms.

Nothing in these Terms affects statutory rights that cannot lawfully be excluded or limited.

25. Indemnity and responsibility for misuse

You are responsible for your own unlawful use of the Service and for content you submit.

Nothing in these Terms requires a consumer to indemnify 2BFound to an extent prohibited or considered unfair under applicable consumer law.

26. Changes to these Terms

We may update these Terms where reasonably necessary because of changes to:

  • the Service;
  • available functionality;
  • legal or regulatory requirements;
  • security requirements;
  • our business or technical operations.

The current version will display its effective date and last-updated date.

Where a change materially affects users’ rights or obligations, we may provide reasonable notice through the Service, website, email or another appropriate method.

Where appropriate, we may require users to accept updated Terms before continuing to use particular functionality.

27. Governing law

These Terms are governed by the laws of England and Wales.

If you are a consumer, you retain any mandatory rights concerning where legal proceedings may be brought under applicable consumer law.

Nothing in these Terms deprives you of mandatory protections provided by applicable law.

28. Entire agreement

These Terms, together with any additional terms expressly applicable to particular paid products or features, constitute the agreement governing your use of the Service.

Our Privacy Policy explains our processing of personal information but does not reduce any rights you have under applicable data protection law.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
